Joseph Stitt (1823-1889) - Will

In Her Majestys Surrogate Court of the County of Norfolk

Bet it Known that on the Nineteenth day of October In the year of our Lord One thousand Eight hundred and Eighty-Nine The last Will and Testament of Joseph Stitt late of the Township of Charlotteville in the County of Norfolk yeoman who died on or about the Sixth day of May In the year of our Lord One thousand Eight-hundred and Eighty-Nine at the said Township of Charlotteville and who at the time of his death had a fixed place of abode at the Township of Charlotteville aforesaid was proved and registered in the said Surrogate Court a true copy of which said last Will and Testament is hereto annexed and that the administration of all and Singular the personal Estate and effects rights and credits of the said Deceased and any way Concerning his will was granted by the aforesaid Court to William Dawson of the Township of Charlotteville in the County of Norfolk yeoman James Stitt of the same place yeoman and Mary Stitt of the same place widow. The executors named in the said Will they all having been first sworn well and faithfully to administer the same by paying the just debts of the deceased and the legacies contained in his will so far as they are hereunto bound by law and to exhibit a true and perfect inventory of all and singular the said estate and effects and credits and to render a just and true account of their executorship whenever required by law so to do.

Joseph Stitt of the Township of Charlotteville in the County of Norfolk and Province of Ontario Farmer being of sound and disposing mind and memory do make and publish this my last will and testament hereby revoking all former wills by me at any teme heretofore made.

1) I hereby constitute and appoint my wife Mary Stitt and William Dawson the senior of the Village of Vittoria and my son James Stitt to be Executors of this my last Will and direct the said Mary Stitt William Dawson the Senior and James STitt to pay all my just debts and funeral expenses and the legacies hereinafter given out of my Estate.

2) After the payment of my said debts and funeral expenses I give to my son James Stitt the sum of Five Dollars and I give to my son John Wesley Stitt the sum of Five Dollars and I give to my son of Albert the sum of Five Dollars and I give to my son Joseph Stitt the sum of Five Dollars and I give to my son David M Stitt the sum of Twenty Dollars and I give to my daughter Hariet wife of Oliver Mather the sum of Fifty Dollars and I give to my Daughter Angeline Stitt the sum of Twenty Dollars and I give to Richard Gamble a boy whom I have taken to raise and with whom I have no bargain made a fair Education such as can be obtained by attending the school section school only and if he remain on the farm until he be of age give him an extra suit of clothes not to exceed Fifteen Dollars in value and the sum of Twenty Dollars in money when ???? legacies except that to Richard Gamble are to be paid as soon after my Decease as conventiently may be done.

3) I give to my wife Mary Stitt as long as she remains unmarried and my widow a good living and her support and maintanence from the produce of my farm and all my household furniture for her sole use.

4) I devise and bequeath to my son William Egbert Stitt my farm being the farm on which I now live and the farm I now own being composed of part of lot number Ten in the Seventh Concession of the Township of Charlotteville in the County of Norfolk and Province of Ontario absolutely and subject to the proper support and maintenance of my wife Mary Stitt and the payment of any part of any of the legacies herein mentioned.

5) And for the payment of the mortgage on my farm I give and devise to my said executors all of my Chattels and a Town lot in the Town of Simcoe in the County of Norfolk and Province of Ontario known and described as Town Lot Number Four in Block A in the Walsh Survey of the said Town of Simcoe.

6) And I direct my said Executors to collect all monies owing all book accounts and notes to me and all monies from any and every Source due to me within as reasonable a time after my decease as they may see fit.

7) I direct [????] Executors after having paid all of my just debts and funeral expenses to pay off and obtain a discharge of the Mortgage against my farm from the proceeds of the sale of my Chattels from the proceeds of the sale of the Town Lot in the Town of Simcoe and from the proceeds of the Collections of my book accounts primissary notes and from every source that money is due to me and then the residue of the money so collected after having paid my just debts and funeral expenses and the mortgage against my farm is to be applied towards the payment of the legacies hereinbefore mentioned then the remainder or any part of the money due on the legacies is to be paid from the produce of my farm at the rate of not less than fifty dollars per annum until the legacies are paid.

8) It is my wish that my son William Egbert continue to ???? my farm next year.

Mary McCrone (1840-1916) - Will

I Mary Stitt of York twp in the County of Washtenaw and state of Michigan being of sound mind and memory, do make, publish and declare this to be my last will and testament, in manner following, viz

First;. I will and direct that all my just debts and funeral expenses be paid in full.

Second;. I give, dvise and bequeath unto my beloved niece, Margaret Knopp, all my clothing, dishes, linen and bedding, and $50, in cash.

Third;. I give, devise and bequeath unto my beloved niece, Catherine McIntosh the sum of five dollars.

Fourth;. I give devise and bequeath unto my beloved nephews, James, John and Donald McCrone, all the rest and residue of my estate, share and share alike, after the above bequests and debts are paid.

I hereby appoint James McCrone of York township, Washtenaw, Co, Executor of this my last will and testament.

Lastly;, I hereby revoke all former wills by me at any time made. In witness whereof, I have hereunto set my hand and seal this 18th day of February in the year of our Lord one thousand nine hundred and sixteen.

Last Will and Testament of James Stitt

I, James Stitt of the township of Charlotteville, after revoking all former wills, do devise and bequeath as follows after paying all my just debts and funeral expenses.

1st;. To Oswald Mabee, son of Ira Mabee the North East quarter of lot No 10 in the sixth con, of Charlotteville, containing 50 acres of land more or less.

2nd;. To Oswald Mabee, the son of Ira Mabee, the East half of one hundred acres being lot 10 in the seventh Con of Charlotteville providing he pays the mortgage on the whole hundred acres lot 10 Con Charlotteville

3rd;. To Thalma Evellyn Stitt, daughter of David M. Stitt British Columbia the West fifty acres of lot No ten in the seventh Con of Charlotteville.

4th;. All my personal property and effects to Mary Stitt widow of Joseph Stitt S'r decessed

5th;. Ninety sven dollars more or less in Molson's Bank & Bank of Commerce Simcoe to be left to Executors in trust to pay debts and expenses.

I name as my executors George Pepper and William Walmsley.

Chas. W. Stitt

One of the foremost business men of Cayuga for more than 20 years, Charles Wesley Stitt, passed away in St. Catharines General Hospital on Sunday, January 8, 1961, in his 68th year. Always an active man, Mr. Stitt had found it hard to take it easier following a heart attack about a year ago. He never fully recovered from the effects of a second attack which occurred about a month ago. Mr. Stitt was taken to St. Catharines General Hospital in the hope that complete rest would prove beneficial.

Born at Walsh, in Norfolk County, February 25, 1893, he had spent his whole life in the Simcoe district until coming to Cayuga 22 years ago. In partnership with W.H. Bartholomew, he purchased the D.P. Foster business. A few years later he purchased Mr. Bartholomew's interest and has since conducted the business himself. Following his return from the service with the R.C.A.F. during the war, his eldest son, Allan, has been associated with his father.

Since coming to Cayuga, Mr. Stitt has always been interested in the affairs of the community. He was for many years a member of the West Haldimand Area High School Board, he being the first representative to that Board from Cayuga, and served a term as Chairman of the Board. He also served on the local Cemetery Board for some years. In church work Mr. Stitt was active in the United Church. Singing in the choir for more than 50 years, he was a regular attendant at the services. He also served on the various official boards of Cayuga United Church of which he was a valued and faithful member. At the time of his death he was an elder. In addition he was a delegate to Presbytery.

Fraternally Mr. Stitt was a veteran member of the I.O.O.F. Simcoe and was associated with Cayuga lodge. He was also a member and Past Master of St. John's Lodge, A.F.&A.M., whose members held a memorial service at the funeral home on Monday evening.

He will be greatly missed in this community where his kindly and friendly manner was known to all with whom he came in contact. His life will long be remembered as a worthy example of fine Christian living.

Surviving are his widow, the former Ada Louise Perry, whom he married on November 7, 1923, three sons and one daughter: Allan P., of Cayuga; Arthur, of Thorold; Dr. Howard, of St. Catharines, and Mrs. (Rev.) Douglas Shuter (Shirley), Union City, New Jersey. In addition to eight grandchildren, a brother Walter, of Simcoe, and a sister, Ethel, of Toronto, also survive. His sister was unable to attend the funeral due to illness.

The funeral was held on Tuesday afternoon from the Kee Funeral Home to Cayuga United Church, which was filled to capacity for the service. The minister, the Rev. U.E. Cronhielm, conducted the service, assisted by the Rev. R.D. Trask, chairman of the Haldimand-Norfolk Presbytery. The great profusion of floral tributes were beautiful indeed and were carried by Messrs. Chas. A. Baird, Leslie Graham, John Eubank, Marshall Murphy, Douglas Murray, Edgar Strohm and Oswald Walton. Interment was made in Oakwood Cemetery, Simcoe. Acting as pallbearers were Messrs. Edgar Jones, E.S. Allen, Robt. Gardiner, Clarke MacDonald, Robt. Jarrett and Thos. Anthony.

STITT, Charles Wesley - Entered into rest in St. Catharines General Hospital on Sunday, Jan. 8, 1961. Charles Wesley Stitt beloved husband of Ada Louise Perry and dear father of Allan, Cayuga; Arthur, Thorold; Dr Howard, St. Catharines; Mrs Douglas Shuter (Shirley), Union City, N.J., and brother of Walter, Simcoe, and Ethel, Toronto, in his 68th year.

Resting at the Kee Funeral Home, Cayuga. Service in Cayuga United Church Tuesday, Jan. 10, at 2 p.m. followed by interment in Oakwood Cemetery, Simcoe. Casket will be open in the church from 1 p.m. till time of service. Memorial service at the funeral home on Monday at 8 p.m. under the auspices of St. John's Lodge A.F.&A.M. No 35.
